Key provisions · Claude summary, not statute text

Qualifying infill housing projects are exempt from CEQA if they meet site, location, consistency, and density conditions, plus tribal, hazard, and labor requirements.

  • Site size. The site may not exceed 20 acres, or four acres for builder’s remedy projects and projects that applied under former Government Code § 65589.5(d)(5). (a)(1)
  • Location and urban setting. The site must be in an incorporated municipality or Census urban area and meet one of four tests of previous urban use or adjoining urban development. (a)(2)-(3)
  • Plan consistency. The project must be consistent with the general plan, zoning, and any local coastal program, shown by substantial evidence, and consistency with either the general plan or zoning suffices. (a)(4)
  • Density and other conditions. The project must reach at least half the default density under Government Code § 65583.2(c)(3)(B), satisfy Government Code § 65913.4(a)(6), avoid demolishing registered historic structures, and exclude transient lodging for projects deemed complete on or after January 1, 2025. (a)(5)-(8)
  • Tribal consultation. The local government sends formal notice to affiliated tribes, which have 60 days to accept, and consultation concludes within 45 days, with one 15-day extension. (b)(1)-(3)
  • Binding tribal conditions. Enforceable consultation agreements and listed protective measures become binding approval conditions unless the tribe and proponent mutually agree otherwise. (b)(4)
  • Hazards and freeway proximity. A phase I assessment is required, with remediation before occupancy, and housing within 500 feet of a freeway must meet listed air filtration and design requirements. (c)
  • Labor standards and notice. Prevailing wage and other labor standards apply as specified, and the lead agency files a notice of exemption with the Office of Land Use and Climate Innovation and the county clerk. (d), (f)
