Rooftop and parking lot solarDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

CEQA does not apply to rooftop or existing-parking-lot solar systems that meet the siting limits and avoid the listed exclusions.

  • Exemption. Installing a solar energy system on an existing building roof or at an existing parking lot is outside CEQA, subject to the exclusions. (a)
  • Equipment siting. Associated equipment must be on the building’s parcel, with limited grid-connection equipment allowed on an adjacent parcel, and may not exceed 500 square feet of ground surface. (c)
  • Native plants. The equipment site may not contain plants protected by the Native Plant Protection Act. (c)(2)
  • Permit exclusions. The section does not apply if equipment would require an individual Clean Water Act permit or waste discharge requirements, an individual take permit, or a streambed alteration permit. (d)
  • Parking lot trees. At a parking lot, the section does not apply to removal of a required tree (unless it dies without a replacement requirement) or of a native tree over 25 years old. (e)
  • Transmission excluded. The section does not apply to any transmission or distribution facility or connection. (f)
