Listed transit, active transportation, and parking-planning projects are exempt from CEQA if they meet local agency, design, labor, and cost-based conditions.

  • Exempt project types. Exempt projects include pedestrian and bicycle facilities, wayfinding, transit prioritization, lane conversions, qualifying zero-emission transit and rail projects, charging infrastructure, and related utility work. (b)(1)-(9)
  • Housing combination. A project combining an exempt project with a housing development project that is subject to nondiscretionary approval or exempt from CEQA is also exempt, but the housing project remains subject to other laws. (b)(10)
  • Parking planning decisions. Local planning decisions to reduce or eliminate minimum parking requirements, institute maximums, restrict parking, or implement transportation demand management are exempt. (b)(11)
  • Basic criteria. A local agency must be the lead agency and approve the project at a public meeting, and the project may not induce single-occupancy trips or widen highways except for minor modifications. (c)(1)-(2)
  • No affordable housing demolition. Construction may not require demolition of affordable housing units. (c)(3)
  • Large-project criteria. Projects estimated above $100 million must also meet plan, mitigation, business case, racial equity and public meeting criteria; projects above $50 million must meet certain meeting and notice requirements. (d), (e)
  • Workforce and notice. The lead agency must certify a skilled and trained workforce, subject to exceptions, and file a notice of exemption. (f), (h)
  • Repeal date. The section is repealed on January 1, 2040. (k)
