Housing Element - Rezone Exemption (SB 131)DIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The section exempts rezonings that carry out an approved housing element’s schedule of actions, with defined exclusions.

  • Housing element rezonings. CEQA does not apply to a rezoning that implements the schedule of actions in an approved housing element under Gov. Code § 65583(c). (a)
  • Distribution and oil and gas. The exemption does not apply to a rezoning that would allow a distribution center or oil and gas infrastructure. (b)(1)(A)
  • Natural and protected lands. The exemption does not apply to a rezoning that would allow construction within natural and protected lands as defined in § 21067.5. (b)(1)(B)
  • Excluded protected lands. The exemption applies to a rezoning whose boundaries contain natural and protected lands if those lands are excluded from the rezoning. (b)(2)(A)(i)
  • Definition carve-out. For that purpose, the definition of natural and protected lands does not include lands described in § 21067.5(p). (b)(2)(A)(ii)
  • Excluded parcels separate. Rezoning of parcels or portions excluded under this paragraph is a separate project subject to CEQA. (b)(2)(B)
