Pub. Resources Code § 21080.29

Playa Vista wetlands land transferDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The section relieves a specified Los Angeles County project from certain mitigation requirements tied to a wetlands acquisition and authorizes the related trust conveyance.

  • Mitigation shortfall not a violation. A qualifying Los Angeles County project does not violate CEQA by not building the specified roadway and Ballona Channel bridge required as mitigation. (a)
  • Easement relinquishment. The relief applies if the improvements were not built due to the owner’s or developer’s relinquishment of easement rights. (a)(1)
  • 400-acre wetlands acquisition. The easement rights must be relinquished in connection with the state’s acquisition of a coastal zone wetlands project of at least 400 acres. (a)(2)
  • Local ordinances inapplicable. City ordinances are inapplicable to the extent they require the improvements or require reprocessing of a permit or map because they were not built. (b)
  • Trust conveyance. If the Wildlife Conservation Board acquires the property under the purchase agreement, the Controller directs the trustee to convey the trust estate to the state for conservation, restoration, or recreation. (c)(1)
  • Enabling legislation. Subdivision (c) serves as the enabling legislation required by the trust declaration. (c)(2)
  • Controller duties superseded. The conveyance supersedes Controller duties under the Probate Code or Revenue and Taxation Code on disposing of net proceeds. (c)(3)
