Pub. Resources Code § 21080.31

Well project exemptionDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The section exempts qualifying drinking water well projects from CEQA until its repeal on January 1, 2028.

  • Exempt well projects. CEQA does not apply to a well project that meets all of the listed conditions. (b)
  • Risk designation. The domestic well or water system must be designated high risk or medium risk in the State Water Resources Control Board’s drinking water needs assessment. (b)(1)
  • Purpose of project. The project must be designed to mitigate or prevent a well failure that would leave residents without an adequate supply of safe drinking water. (b)(2)
  • Lead agency determinations. The lead agency must determine, among other things, that the project does not primarily serve irrigation or future growth, does not affect wetlands or sensitive habitats, and has no unusual circumstances or significant cumulative impact. (b)(3)
  • Listed sites and historic resources. The lead agency must determine the site is not on a Gov. Code § 65962.5 list and the project cannot substantially change a historical resource’s significance. (b)(3)(D)–(E)
  • Federal assistance check. Before finding the project exempt, the lead agency must contact the state board about the effect on federal financial assistance. (c)
  • Notice of exemption. The lead agency must file a notice of exemption with the Office of Planning and Research and the county clerk, and state whether other exemptions could apply. (d)
  • Repeal date. The section remains in effect only until January 1, 2028. (e)
