Military base reuse plan EIRsDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

Lead agencies preparing EIRs for military base reuse plans may use a closure-date baseline if they follow hearing, consultation and written-statement steps.

  • Reuse plan defined. A reuse plan is an initial plan for reuse of a closed or realigned base, with development policies, diagrams, and a designation of general distribution and location of land uses. (a)
  • Closure-date baseline. The significance determination may be made in the context of conditions when the federal closure decision became final. (b)(1)
  • No project alternative. The no project alternative must discuss existing conditions and what could reasonably be expected to occur without the plan. (b)(1)
  • Single project. Activities under the reuse plan are deemed a single project, with further review if a § 21166 event occurs. (b)(2)
  • Pre-EIR requirements. The lead agency must hold a public hearing on the federal EIS, consult agencies, and state in writing how it will integrate the baseline and the reasons supporting it. (c)
  • Hazardous materials. The section does not limit review of hazardous or toxic materials or constrain their regulation by prior activity levels. (d)(1)
  • Timing of applicability. The section may apply to a reuse plan EIR if the notice of preparation is issued within one year of the federal record of decision, or before January 1, 1997 if later, and the EIR is certified within five years. (d)(3)
  • Later development. All subsequent development remains subject to all applicable federal, state and local laws. (e)
