Kern County oil and gas permittingDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The Legislature deems Kern County’s oil and gas SSREIR sufficient for the 2025 zoning revisions, with limits near health protection zones and a 2036 sunset.

  • EIR deemed sufficient. The Kern County SSREIR is deemed sufficient for adopting the 2025 oil and gas zoning ordinance revisions as enacted as of January 1, 2026, with no further CEQA review. (b)
  • Covered approvals. Projects approved under that ordinance that comply with Article 4.6 as it read on January 1, 2025 require no further CEQA review. (c)
  • Responsible agencies. Responsible agency reliance on the SSREIR satisfies its CEQA obligations and is not subject to challenge under § 21166. (e)
  • Health protection zones. No approval may rely on the SSREIR for any operation located in a health protection zone. (f)
  • State lead agency. The Geologic Energy Management Division is lead agency for certain well projects within 3,200 feet of a residence, school, youth center, health care facility, live-in housing, or public-facing business. (g)
  • Annual cap. The Division may not approve more than 2,000 notices of intention per year for new wells in reliance on the SSREIR unless the Energy Commission makes a specified finding. (h)
  • Later ordinances. Ordinances enacted on or after January 1, 2026 need further environmental review unless they only correct minor typographical or formatting errors. (i)
  • Sunset. The section is repealed on January 1, 2036 unless extended. (j)
