Small water and sewer project exemptionDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The section exempts defined small drinking water and sewer projects from CEQA, subject to environmental conditions and labor standards, until January 1, 2032.

  • Exempt project benefits. CEQA does not apply to a qualifying project that primarily benefits a small disadvantaged community water system or state small water system by improving water quality, supply, or reliability, encouraging conservation, or serving existing residences with contaminated or failing water. (b)(1)
  • Covered project types. A project is limited to specified drinking water facilities of defined size, such as wells up to 250 gpm, tanks up to 250,000 gallons, and pipelines in road rights-of-way, or sewer service to a disadvantaged community. (a)(6)(A)
  • Excluded facilities. Facilities built primarily to serve irrigation or future growth, and facilities that dam, divert, or convey surface water, are not projects. (a)(6)(B)
  • Environmental conditions. The project must not affect wetlands or coastal sensitive habitat, involve unusual circumstances, sit on a listed hazardous waste site, or change a historical resource, and its construction and cumulative impacts must be addressed. (c)
  • Public agency workforce rule. For public agency projects, entities must commit to using a skilled and trained workforce to be prequalified or awarded contracts, unless a listed project labor agreement exception applies. (d)
  • Private project labor rules. For private projects, the applicant must certify prevailing wage compliance (or public work status) and use of a skilled and trained workforce, with monthly compliance reports. (e)
  • Penalties. Failure to report incurs a $10,000 monthly civil penalty, and contractors not using a skilled and trained workforce face $200 per day per worker, assessed within 18 months of completion. (e)(2)(C)
  • Consultation and notice. The lead agency must contact the state board about federal assistance effects before claiming the exemption, and must file a notice of exemption when approving the project. (b)(2), (f)
