Key provisions · Claude summary, not statute text

Projects near airports require use of the Airport Land Use Planning Handbook in EIRs and consideration of hazards and noise before a negative declaration.

  • Covered area. The rule applies to projects within an airport land use compatibility plan boundary, or within two nautical miles of a public or public use airport if no plan has been adopted. (a)
  • Handbook as resource. For an EIR, the Airport Land Use Planning Handbook and other documents must be used as technical resources on airport-related safety hazards and noise. (a)
  • Negative declaration condition. A lead agency may not adopt a negative declaration unless it considers whether the project will cause a safety hazard or noise problem for people using the airport or living or working in the project area. (b)
