Pub. Resources Code § 21080.09

Public higher education campus plansDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The section sets how CEQA applies to public university and medical center planning and enrollment.

  • EIR for plans and siting. Selecting a campus location and approving a long-range development plan are subject to CEQA and require an EIR. (b)
  • Tiered project review. Projects on a campus or medical center may be addressed in a tiered analysis based on the plan EIR. (c)
  • Enrollment not a project. Enrollment or changes in enrollment, by themselves, are not a project under § 21065. (d)
  • Plans effective after analysis. Academic and campus population plans become effective only after their effects are analyzed in the plan EIR or tiered analysis. (d)
  • Court-ordered EIR. If a court finds population growth exceeds the analyzed projections and causes significant impacts, it may order a new, supplemental, or subsequent EIR. (e)(1)
  • 18-month injunction limit. A court may enjoin excess population increases only if no such EIR is certified within 18 months of the order. (e)(1)
  • Existing enrollment injunctions. Injunctions or judgments in effect on the subdivision’s effective date that suspend or affect enrollment are unenforceable. (e)(2)
  • Retroactivity. The SB 118 amendments apply retroactively to enrollment-related decisions made before that bill’s effective date. (e)(3)
