Pub. Resources Code § 21080.5

Certified regulatory programsDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

A state regulatory program certified by the Secretary of the Resources Agency may use its own environmental documentation in place of an EIR.

  • Documentation in lieu of EIR. A plan or other written documentation meeting subdivision (d)(3) may be submitted instead of an EIR if the program is certified. (a)
  • Covered activities. The section applies only to programs involving issuance of a lease, permit, license, certificate or other entitlement, or adoption or approval of standards, rules, regulations or plans. (b)
  • Exempt chapters. A certified program is exempt from Chapter 3, Chapter 4 and § 21167, except as provided in Article 2 of Chapter 4.5. (c)
  • Certification criteria. The program must use an interdisciplinary approach and meet criteria on enabling legislation, agency rules and the required documentation. (d)
  • Secretary’s role. The Secretary certifies qualifying programs and withdraws certification if a program no longer qualifies, reviewing only the generic requirements of subdivision (d). (e)
  • 30-day challenge period. Actions challenging an approval under a certified program, or the Secretary’s certification, must be commenced within 30 days of the notice filing or certification. (g), (h)
  • Deemed state agencies. County agricultural commissioners, and air districts (with a limit for nonattainment area plans), are treated as state agencies for this section. (i), (j)
