Health & Saf. Code § 50052.5

Affordable housing cost by income levelDIVISION 31. HOUSING AND HOME FINANCE › PART 1. STATE HOUSING POLICY AND GENERAL PROVISIONS › CHAPTER 2. Definitions

Key provisions · Claude summary, not statute text

Sets the maximum “affordable housing cost” for assisted owner-occupied housing by household income level, measured against gross income or area median income adjusted for family size appropriate for the unit.

  • Assistance before 1991. For owner-occupied housing assisted before January 1, 1991, where compliance is a condition of assistance, affordable housing cost for lower income households may not exceed 25 percent of gross income. (a)
  • Extremely low and very low. Affordable housing cost may not exceed 30 percent times 30 percent of area median income for extremely low income households, or 30 percent times 50 percent of area median income for very low income households, adjusted for family size appropriate for the unit. (b)(1)–(2)
  • Lower income. For lower income households above the very low income limit and not above 70 percent of area median income, the limit is 30 percent times 70 percent of area median income. For a lower income household at or above 70 percent of area median income, a state or local funding agency may optionally require that cost not exceed 30 percent of gross income. (b)(3)
  • Moderate income. Affordable housing cost may not be less than 28 percent of gross income nor exceed 35 percent times 110 percent of area median income; for households above 110 percent of area median income, a funding agency may optionally require that cost not exceed 35 percent of gross income. (b)(4)
  • Department regulations. The department adopts criteria defining gross income, family size adjustments, and housing cost, may provide alternative criteria consistent with federal law, and must include a method for determining the maximum construction cost, mortgage loan, or sales price that makes housing available at affordable housing cost. The agency may adopt alternative criteria and percentages for agency-assisted housing. (c), (e)
  • Renters and cooperatives. For moderate- and lower income tenants of rental housing and members or shareholders of cooperative or limited equity cooperative housing, “affordable housing cost” means affordable rent as defined in § 50053. (d)
  • Definitions. “Area median income” is as published by the department under § 50093; “moderate income household” means “persons and families of moderate income” under § 50093; and, absent pertinent federal statutes, “adjusted for family size appropriate to the unit” means one person for a studio up to five persons for a four-bedroom unit. (f)–(h)
