Pub. Resources Code § 21080

Pub. Resources Code § 21080

Scope, exemptions, and review standardDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The section sets the reach of CEQA, its exclusions, and the threshold for choosing between a negative declaration and an EIR.

  • Discretionary projects covered. CEQA applies to discretionary projects of public agencies, including zoning ordinance enactments and amendments, variances, conditional use permits, and tentative subdivision maps, unless exempt. (a)
  • Ministerial projects excluded. The division does not apply to ministerial projects carried out or approved by public agencies. (b)(1)
  • Other exclusions. The division also does not apply to emergency repairs, disaster-related restoration, rejected or disapproved projects, and all classes of projects designated under § 21084, among other listed activities. (b)(2)–(16)
  • Negative declaration. A lead agency must adopt a negative declaration if there is no substantial evidence of a significant effect, or if applicant revisions made before public release would avoid the effect and no substantial evidence shows the revised project may have one. (c)
  • EIR required. An environmental impact report must be prepared if substantial evidence in the whole record shows the project may have a significant environmental effect. (d)
  • Substantial evidence defined. Substantial evidence includes fact, reasonable assumptions predicated on fact, and expert opinion supported by fact, and excludes argument, speculation, and unsubstantiated opinion. (e)
  • Substituting mitigation. After a public hearing, the lead agency may replace mitigation measures in a mitigated negative declaration with equivalent or more effective ones without recirculation. (f)
  • Invalidated conditions. If a necessary condition of approval is set aside, the negative declaration approval is invalid and new review is required unless an equivalent substitute condition is adopted after a public hearing. (g)
