Carbon dioxide pipeline reviewDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

Carbon dioxide pipeline projects require an EIR or equivalent documentation, special notice, and State Fire Marshal review.

  • EIR required. For a project including a CO2 pipeline subject to the Elder California Pipeline Safety Act, the lead agency must prepare and certify an EIR or equivalent documentation. (b)
  • Notice of draft. On completing the draft, the lead agency must notify owners and operators of sensitive receptors within one-quarter mile and the State Fire Marshal, consistent with § 21092. (c)(1)
  • Notice contents. The notice must include a brief description with the proposed map, the location on a USGS topographic map, where copies are available, and the review period. (c)(1)(A)-(D)
  • Substantial compliance. Failure of a person to receive notice does not invalidate agency action if there has been substantial compliance. (c)(2)
  • State Fire Marshal notification. At least 60 days before certification or adoption, the lead agency must notify the State Fire Marshal and provide enough information for a determination. (d)(1)
  • Consistency confirmation. The State Fire Marshal must give written confirmation whether the pipeline is consistent with the Act and publish the determination on its website. (d)(2)-(3)
