Infill project limited reviewDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

Infill projects consistent with a prior planning level EIR face limited CEQA review of project-specific effects, and any new EIR need not consider alternative locations, densities, or growth inducement.

  • Limited review. Review of a qualifying infill project is limited to effects specific to the project or site that were not addressed as significant in the prior EIR, or that new information shows are more significant. (a)(1)
  • Substantial evidence. The lead agency’s determination must be supported by substantial evidence. (a)(1)
  • Uniform standards. An effect is not project-specific if uniformly applicable development policies or standards will substantially mitigate it, based on a substantial evidence finding. (a)(2)
  • EIR limits. If an EIR is needed, it need not consider alternative locations, densities, and intensities, or growth inducing impacts. (b)
  • Eligibility. The project must meet one of three planning criteria (SCS or APS consistency, small walkable community, or 20 units per acre or 0.75 FAR in an MPO without an SCS) and satisfy statewide performance standards. (c)
  • Operative condition. The section applies after the Secretary adopts and certifies the statewide standards guidelines under § 21094.5.5. (d)
