Lead agency determinations; single-condition housingDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The lead agency decides exemption and document type, and a housing project failing an exemption by one condition is reviewed only for that condition.

  • Lead agency determination. The lead agency determines exemption and the type of environmental document, and the determination is final and conclusive on all persons unless challenged under § 21167. (a)
  • Single-condition limit. Where a housing development project would be exempt but for a single condition, CEQA applies only to effects caused solely by that condition. (b)(1)
  • Scope of study. An initial study or EIR need only examine effects the lead agency finds, on substantial evidence, are caused solely by that condition. (b)(2)
  • No alternatives or growth. An EIR under this subdivision need not discuss alternatives or growth-inducing impacts. (b)(3)
  • Exclusions. The single-condition rule does not apply to dissimilar projects, projects failing on two or more conditions, distribution center or oil and gas projects, natural and protected lands, or certain builder’s remedy or former HAA projects on sites over four acres. (b)(4)
  • Pre-application consultation. For § 21065(c) projects, the lead agency must consult before filing on request of a potential applicant. (c)
