Five-hearing limit for housing projectsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 3. Administration

Key provisions · Claude summary, not statute text

Limits a city or county to five hearings on a housing development project that complies with applicable, objective general plan and zoning standards once its application is deemed complete.

  • Five-hearing limit. After the application is deemed complete, the city, county, or city and county may not conduct more than five hearings under § 65905 or any other law, ordinance, or regulation requiring a public hearing on the project's approval. (a)
  • Continued hearings and decision. A continued hearing counts as one of the five, and the agency must approve or disapprove the application at any of the five hearings consistent with Permit Streamlining Act timelines. (a)
  • Deemed complete. The application has met all requirements of the relevant § 65940 list available when it was submitted. (b)(1)
  • Hearing. Includes any public hearing, workshop, or similar meeting, including appeals and meetings relating to § 65915, by any city or county body or hearing officer, but not a hearing to review a legislative approval such as a general plan, specific plan, or zoning amendment. (b)(2)
  • Housing development project. Has the § 65589.5(h)(2) meaning and includes projects with no discretionary approvals, projects with both discretionary and nondiscretionary approvals, and a proposal to construct a single dwelling unit. (b)(3)
  • Substantial evidence standard. A project is deemed consistent if substantial evidence would allow a reasonable person to conclude it is consistent; receipt of a density bonus, incentives, concessions, or waivers under § 65915 is not a valid basis for finding inconsistency. (c)(1)
  • Zoning inconsistent with general plan. A project consistent with objective general plan standards is not inconsistent with zoning and does not require a rezoning where the zoning is inconsistent with the general plan. If the agency meets § 65589.5(j)(2) documentation requirements, it may apply the objective standards of zoning consistent with the general plan, applied to accommodate the general plan density proposed by the project. (c)(2)
  • CEQA and effect. The section does not modify CEQA requirements or standards of review; the amendments to (b) and (c) are declaratory of existing law, but the (b)(3)(B) amendment does not affect applications submitted before January 1, 2022. (d)–(e)
