Transit agency fiscal emergency actionsDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

Publicly owned transit agencies may be exempt from CEQA for budget-driven fee increases or service reductions after a fiscal emergency finding and hearing.

  • Eligible agencies. Only publicly owned transit agencies qualify, excluding those created under Public Utilities Code § 130050.2. (a)
  • Exempt actions. CEQA does not apply to actions on or after July 1, 1995, implementing budget reductions caused by revenue shortfalls. (b)
  • Mitigation carve-out. The exemption does not cover reductions of services adopted as mitigation measures or required for environmental protection. (c)
  • Finding and hearing. The agency must first find a fiscal emergency and hold a public hearing, then respond within 30 days to public suggestions. (d)(1)
  • Limited action types. Actions are limited to initiating or increasing fees, rates, or charges, or reducing or eliminating existing transit services. (d)(1)
  • Fiscal emergency test. A fiscal emergency means projected negative working capital within one year, computed under the stated formula. (d)(2)
