Pub. Resources Code § 21083.2

Archaeological resourcesDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The section governs how CEQA treats unique archaeological resources, including preservation, mitigation funding, and cost caps.

  • Unique versus nonunique. An EIR addresses unique archaeological resources but not nonunique ones, and a negative declaration issues if only nonunique resources would otherwise prevent it. (a)
  • Preservation in place. If a project will damage a unique resource, the lead agency may require reasonable efforts to preserve it in place, such as avoidance, conservation easements, capping, or open space. (b)
  • Applicant funding guarantee. If not preserved in place, the applicant must guarantee payment of one-half the estimated mitigation cost, and approval may not occur sooner than 60 days after the recommended special EIR is completed. (c)
  • Excavation limits. Excavation as mitigation is limited to the parts of the resource that would be damaged, and is not required if completed studies have adequately recovered the information. (d)
  • Applicant payment caps. Applicant payments are capped at 0.5 percent of projected project cost for commercial or industrial projects and 0.75 percent for single-unit housing projects. (e)(1)–(2)
  • Multiunit housing cap. For multiunit housing, the cap is 0.75 percent of projected cost for the first unit plus $200 per unit for the next 99, $150 for the next 400, and $100 per unit beyond 500. (e)(3)
  • 90-day excavation period. Unless special circumstances warrant, field excavation must be completed within 90 days after final approval needed to implement physical development, which the applicant may extend. (f)
  • Accidental discoveries. The lead agency may provide for sites discovered during construction, including evaluation, contingency funding, and time, while work continues on other parts of the site. (i)
