Key provisions · Claude summary, not statute text

Requires the planning agency, after a general plan is adopted, to recommend means of implementing it and to file an annual progress report by April 1 with the legislative body, the Office of Land Use and Climate Innovation, and HCD, including detailed housing element and housing production data.

  • Implementation duty. The planning agency shall investigate and recommend to the legislative body reasonable and practical means of implementing the general plan as a guide for orderly growth, open-space and resource conservation, and efficient expenditure of public funds. (a)(1)
  • Annual report. By April 1 each year, the planning agency shall report to the legislative body, the Office of Land Use and Climate Innovation, and HCD on the status of the plan and progress in its implementation. (a)(2), (a)(2)(A)
  • RHNA progress. The report must show progress in meeting the jurisdiction’s share of regional housing need (including extremely low income need) for the sixth and previous revisions, and local efforts to remove governmental constraints; the housing element portion uses HCD standards, forms, and definitions (not subject to the APA), must describe program actions and deadline compliance, and is considered at an annual public meeting allowing oral and written public comment. (a)(2)(B)(i)–(ii)
  • Optional unit credits. The report may include units completed under § 65583.1(c) (with documentation of compliance) and existing deed-restricted units averaging no more than 45% of AMI, at least 15 years old, and substantially rehabilitated with at least $60,000 per unit in local funds (those units are not counted for § 65913.4(a)(4) affordability); it must include lower income student housing units granted a density bonus under § 65915(b)(1)(F). (a)(2)(B)(iii)–(v)
  • Applications and approvals. The report lists housing development applications received (whether ministerial or discretionary and, beginning with the April 1, 2027 report, whether subject to replacement or relocation obligations), units in all applications, and units approved and disapproved by income category within each “opportunity area” (highest, high, moderate, or low resource area on the CTCAC/HCD Opportunity Map), with acutely and extremely low income categories for the seventh and later revisions. (a)(2)(C)–(E)
  • General plan and rezoned sites. The report states the degree of compliance with the § 65040.2 guidelines and the date of the last general plan revision, and lists sites rezoned to accommodate need not met by the inventory (under §§ 65583(c)(1) and 65584.09) plus any additional sites required by § 65863. (a)(2)(F)–(G)
  • Production report. The report states units demolished and new units issued a completed entitlement, building permit, or certificate of occupancy in the cycle by AMI category, distinguishing rental and for-sale units and using a unique site identifier including the assessor’s parcel number; beginning April 1, 2027, it includes required and delivered replacement units by income level. Napa County and the City of Napa may report units under a § 65584.08 agreement. (a)(2)(H)
  • Streamlined and bonus projects. The report includes data on § 65913.4 applications, approvals, permits, and units by AMI category; density bonus applications received and approved with project-level data (bonus percentage, affordable percentage, incentives or concessions, parking waivers or reductions); Chapter 4.1 (§ 65912.100) project location, status, units, tenure, and income category; and § 65913.16 applications, approvals, permits, and units by income category. (a)(2)(I), (L), (M), (O)
  • Other report contents. The report includes Local Government Planning Support Grants Program information if funded, progress on tribal consultation and protection of places under Pub. Res. Code §§ 5097.9 and 5097.993, and historic designations made in the past year with the entitlement, permit, and unit status of housing projects proposed for those designations. (a)(2)(J), (K), (N)
  • Demolition and replacement. Beginning with the April 1, 2027 report, the report covers units approved for demolition and demolished (location by APN, approval date, rental and ownership units, protected units by income level, approved uses, and relocation assistance), and replacement units required for approved non-housing development projects (location, developer, and anticipated completion date). (a)(2)(P)–(Q)
  • HCD corrections. HCD may request corrections to the housing element portion within 90 days of receipt; the planning agency must correct within 30 days, after which HCD may reject a report not in substantial compliance and must state its reasons in writing. (b)(1)
  • Court enforcement. If a court finds a jurisdiction failed to submit a substantially compliant housing element report within 60 days of the deadline, it shall order compliance within 60 days, may grant sanctions on motion if the order is not followed, and retains jurisdiction to issue further orders. (b)(2)
  • Posting and forms. HCD shall post submitted reports on its website within a reasonable time; the non-housing portion of the report uses standards, forms, and definitions adopted by the Office of Land Use and Climate Innovation, not subject to the APA. (c)–(d)
