Infill residential traffic findingsDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

Qualifying small transit-proximate infill housing projects need not receive § 21081(a) traffic findings if prior project area EIR mitigation is incorporated.

  • Eligible project. A residential project of up to 100 units at 20 units per acre minimum, within one-half mile of a transit stop, on an urbanized infill site, consistent with local traffic and circulation policies. (a)
  • Required mitigation. The city or county must require incorporation of mitigation from a previously certified project area EIR. (a)
  • Pedestrian and bicycle. The agency may still adopt feasible mitigation for pedestrian and bicycle safety impacts. (b)
  • Exceptions. The relief does not apply if the application is more than five years after EIR certification, a major change occurred, traffic overriding considerations were adopted, or the project exceeds four acres. (c)
  • No splitting. A project may not be divided into smaller projects to qualify. (d)
  • Analysis still required. The agency must still analyze traffic effects and determine whether they may be significant. (e)
