Gov. Code § 8899.50

Gov. Code § 8899.50

Duty to affirmatively further fair housingTITLE 2. GOVERNMENT OF THE STATE OF CALIFORNIA › DIVISION 1. GENERAL › CHAPTER 15. Affirmatively Furthering Fair Housing

Key provisions · Claude summary, not statute text

Requires every public agency to administer its housing and community development programs and activities in a manner that affirmatively furthers fair housing.

  • Definitions. Defines “affirmatively furthering fair housing” (meaningful actions, beyond combating discrimination, that overcome segregation, address disparities in housing needs and access to opportunity, transform racially and ethnically concentrated areas of poverty, and foster compliance with civil rights and fair housing laws; the duty extends to all housing and community development activities) and “public agency.” (a)(1)
  • Covered agencies. “Public agency” includes the state and its offices (including the California State University), cities, counties and charter jurisdictions, redevelopment successor agencies, public housing authorities and agencies, and other political subdivisions receiving HUD CDBG, ESG, HOME, or HOPWA funds. (a)(2)
  • Mandatory duty. A public agency shall administer its housing and community development programs to affirmatively further fair housing and take no action materially inconsistent with that obligation; this is a mandatory duty, declared a clarification of existing law. (b)(1)–(2)
  • Interpretation. The section is interpreted consistent with HUD’s July 16, 2015 Affirmatively Furthering Fair Housing Final Rule and commentary (80 Fed. Reg. 42272–42371); later federal amendment, suspension, or revocation of that rule does not affect interpretation. (c)
  • Agency discretion. The section neither requires nor prohibits any one particular action in selecting meaningful actions to fulfill the obligation. (d)
