Pub. Resources Code § 21082.3

Tribal cultural resource mitigation and confidentialityDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

Agreed tribal mitigation is enforceable, tribe-submitted information is confidential, and certification depends on consultation having concluded or been declined.

  • Agreed mitigation. Mitigation measures agreed in consultation under § 21080.3.2 are recommended for inclusion in the document and monitoring program, if found to avoid or lessen the impact, and are fully enforceable. (a)
  • Required discussion. The document must discuss whether the project significantly impacts a tribal cultural resource and whether feasible alternatives or mitigation avoid or substantially lessen the impact. (b)
  • Confidentiality. Tribe-submitted information, including location and use, may not be disclosed without the tribe’s prior consent, and published information goes in a confidential appendix. (c)(1)
  • Applicant confidentiality. Project applicants and their advisers must maintain the confidentiality of exchanged information, subject to listed exceptions. (c)(2)
  • Conditions for certification. The lead agency may certify an EIR or adopt a mitigated negative declaration only if consultation concluded, the tribe failed to engage, or the tribe failed to request consultation within 30 days after notice. (d)
  • Fallback mitigation. If consultation yields no agreed measures or does not occur and substantial evidence shows a significant effect, the lead agency considers feasible mitigation under § 21084.3(b). (e)
  • Confidential appendix. Confidential information is published in a confidential appendix with a general description in the public document. (f)
