University housing alternatives limitDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The section relieves public universities from analyzing alternative locations in EIRs for certain campus housing projects.

  • No location alternatives. Public higher education institutions need not consider alternatives to the location of a residential or mixed-use housing project in its EIR if both conditions are met. (b)
  • Site size and surroundings. The site must be no more than five acres and substantially surrounded by qualified urban uses. (b)(1)
  • Prior plan evaluation. The project must have already been evaluated in the EIR for the campus’s most recent long-range development plan. (b)(2)
  • Housing project defined. A residential or mixed-use housing project is residential only or has at least two-thirds of its square footage designated for residential uses. (a)(3)
  • Substantially surrounded. At least 75 percent of the site perimeter must adjoin, or be separated only by an improved public right-of-way from, parcels developed with qualified urban uses. (a)(4)
