Preliminary application for housing projectsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.5. Review and Approval of Development Projects › ARTICLE 3. Applications for Development Projects

Key provisions · Claude summary, not statute text

Defines the information that makes up a preliminary application for a housing development project and sets deadlines to keep it in effect.

  • Preliminary application. An applicant is deemed to have submitted a preliminary application upon providing all listed information to the city, county, or city and county and paying the permit processing fee. (a)
  • Project information. Location and parcel numbers; existing uses and major alterations; site plan, elevations, massing, height, and square footage; proposed land uses; parking spaces; requested subdivision approvals; applicant contact and owner consent; existing units to be demolished and whether occupied; and recorded public easements. (a)(1)–(5), (12)–(13), (15), (17)
  • Site conditions. Pollutant point sources; species of special concern; whether the site is in a very high fire hazard severity zone, wetlands, a hazardous waste site, a special flood hazard area, an earthquake fault zone, or a streambed alteration resource; historic or cultural resources; coastal zone wetlands, habitat, tsunami run-up zone, or public access; and a site map and aerial photograph. (a)(6)–(9), (14), (16)
  • Affordability and density bonus. The number of below market rate units and their affordability levels, and the number of bonus units and any incentives, concessions, waivers, or parking reductions requested under § 65915. (a)(10)–(11)
  • Fee and exaction estimate. The applicant may request a preliminary fee and exaction estimate, provided within 30 business days; other agencies, such as school or special districts, must provide fee schedules on request without delay. The estimate is a good faith estimate for informational purposes only and is not legally binding. (b)
  • Forms. Each local agency compiles a checklist and application form; the Department of Housing and Community Development adopts a standardized form for use where a local agency has not; neither may request information beyond subdivision (a). (c)
  • Project revisions. If the project changes by 20 percent or more in units or square footage of construction, excluding density bonus, incentive, concession, or waiver increases, the preliminary application is not satisfied until the information is resubmitted. (d)
  • Deadlines. A full development application must be submitted within 180 calendar days; if it is found incomplete under § 65943, missing information must be submitted within 90 days of the written identification, or the preliminary application expires. No affirmative completeness determination is required. (e)
  • Tribal cultural resources. Submittal does not preclude later listing of a tribal cultural resource on a historic register, and such a listing is not a change to the ordinances, policies, and standards in effect at submittal for § 65589.5 or other purposes. (f)
