Counties must require mitigation when a project may significantly affect oak woodlands, with specified exemptions.

  • County determination. A county must determine whether a project may convert oak woodlands with a significant effect. (b)

  • Tree planting limits. Planting and maintaining trees is an alternative, with maintenance ending seven years after planting and mitigation limited to one-half of the requirement. (b)(2)
  • Fund contribution. An applicant may contribute to the Oak Woodlands Conservation Fund but then may not receive a grant from the fund for the project’s mitigation. (b)(3)
  • Housing exemption. Affordable housing projects for lower income households in an urbanized area or sphere of influence are exempt from this section. (d)(2)
  • Other exemptions. Projects under an approved NCCP, oak woodland conversion on commercial agricultural land, and § 21080.5 projects are also exempt. (d)(1), (3), (4)
  • Limited compliance effect. Adopting the measures is deemed compliance with CEQA only as to effects on oaks and oak woodlands. (e)
