Public review periods and commentsDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

The section sets minimum review periods, State Clearinghouse procedures, and comment-handling duties for CEQA documents.

  • Draft EIR review. The public review period for a draft EIR is at least 30 days, or at least 45 days if state agencies are involved or the project has statewide, regional, or areawide significance. (a)
  • Negative declaration review. The review period for a proposed negative declaration or mitigated negative declaration is at least 20 days, or at least 30 days in those same circumstances. (b)
  • State Clearinghouse period. If the Clearinghouse review period is longer, the public review period must be at least as long, and complete submittals must be distributed within three working days. (c)(1), (c)(3)
  • Consider timely comments. The lead agency must consider comments received within the public review period. (d)(1)
  • Written responses on EIRs. For a draft EIR, the lead agency must evaluate comments on environmental issues and prepare written responses describing the disposition of each significant issue raised. (d)(2)
  • Email comments. The lead agency must accept comments by email and treat them as equivalent to written comments. (d)(3)
  • Shortened review limits. Shortened State Clearinghouse review may not be under 30 days for a draft EIR or 20 days for a negative declaration, and requires a written request from the lead agency’s decisionmaking body. (e)(2)–(3)
  • No shortening for major projects. A shortened period may not be approved for a project of statewide, regional, or areawide environmental significance, and approval must precede and be reflected in the public notice. (e)(5)–(6)
