Streamlined review for plan-consistent projectsDIVISION 13. ENVIRONMENTAL QUALITY › CHAPTER 2.6. General

Key provisions · Claude summary, not statute text

Projects consistent with a zoning, community plan or general plan that had a certified EIR get review limited to project- or parcel-specific effects.

  • Zoning or community plan. Review of a consistent subdivision map or project is limited to effects peculiar to the parcel or project not addressed as significant in the prior EIR, or shown by substantial new information to be more significant. (a)
  • General plan consistency. The same limit applies to a development project consistent with a general plan for which an EIR was certified. (b)
  • Offsite and cumulative impacts. Potentially significant offsite and cumulative impacts not discussed in the prior EIR must still be analyzed, and feasible prior-EIR mitigation must be undertaken or the section does not apply to that effect. (c)
  • Hearing finding. The lead agency must make a finding at a public hearing on whether the mitigation measures will be undertaken. (c)
  • Uniformly applied policies. An effect is not peculiar if previously adopted, uniformly applied development policies or standards, with a substantial-evidence finding, will substantially mitigate it, unless new information shows otherwise. (d)
  • Community plan rezonings. A rezoning consistent with a community plan is a project subject to exemption under this section. (e)
  • Standing limit. A person must have participated in the public hearing to challenge the finding, unless the agency failed to give required notice. (f)
