Key provisions · Claude summary, not statute text

Sets the maximum “affordable rent,” including a reasonable utility allowance, for assisted rental housing developments by household income level.

  • Assistance before 1991. For rental developments assisted before January 1, 1991, affordable rent for lower income households may not exceed the percentage of gross income set by department regulation, which must be at least 15 and no more than 25 percent. (a)
  • Acutely low income. The product of 30 percent times 15 percent of area median income adjusted for family size appropriate for the unit, for leases entered into on or after January 1, 2022. (b)(1)(A)
  • Extremely low and very low. The product of 30 percent times 30 percent of area median income for extremely low income households, and 30 percent times 50 percent for very low income households. (b)(1)(B)–(C)
  • Lower income. For lower income households above the very low income limit, 30 percent times 60 percent of area median income; for those above 60 percent of area median income, a funding agency may optionally set rent at no more than 30 percent of gross income. (b)(1)(D)
  • Moderate income. The product of 30 percent times 110 percent of area median income; for households above 110 percent, a funding agency may optionally set rent at no more than 30 percent of gross income. (b)(1)(E)
  • 80 percent lower income developments. For a development dedicating at least 80 percent of units (excluding manager's units) to lower income households, affordable rent may not exceed the California Tax Credit Allocation Committee's maximum lower income rents if, on or after January 1, 2025, it receives low-income housing tax credits, tax-exempt private activity or general obligation bonds, or loans or grants that use that committee's rent and income limits. (b)(2)
  • Department regulations. Regulations must permit alternative percentages of income for agency-assisted rental and cooperative developments under § 50462(f), define gross income, family size adjustments, and rent, and may provide alternative criteria consistent with federal law. (c)
  • Definitions. “Area median income” and “moderate-income household” have their § 50093 meanings. “Adjusted for family size appropriate to the unit” means one person for a studio up to five persons for a four-bedroom unit, unless conflicting state or federal law applies. (d)–(e)
