Key provisions · Claude summary of the digest, not bill text

Budget trailer bill (Ch. 24, Stats. 2025, effective June 30, 2025) that added several CEQA exemptions, including the housing element rezoning exemption, and narrowed CEQA review and litigation records.

  • Housing element rezonings. Added § 21080.085: CEQA does not apply to a rezoning that implements the schedule of actions in an approved housing element under Gov. Code § 65583(c), except rezonings allowing a distribution center, oil and gas infrastructure, or construction on natural and protected lands (§ 21067.5); protected lands may be carved out of the rezoning, and the carved-out parcels are a separate project.
  • Single-condition rule. Amended § 21080.1 so that a housing development project that misses a statutory or listed categorical exemption because of a single condition is reviewed only for the effects of that condition, with no alternatives or growth-inducing analysis in an EIR.
  • New definitions. Added “distribution center” (§ 21060.4), “oil and gas infrastructure” (§ 21064.8) and “natural and protected lands” (§ 21067.5), which limit several of the new exemptions.
  • Other exemptions. Added exemptions for farmworker housing (§ 21080.44), community water system projects (§ 21080.48), wildfire risk reduction (§ 21080.49), the climate adaptation strategy (§ 21080.55), bond-funded parks and trails (§ 21080.57), day care, clinics, food banks and advanced manufacturing (§ 21080.69), and high-speed rail facilities (§ 21080.70); extended and expanded § 21080.47 and § 21080.51.
  • Infill site map. Added § 21083.03, requiring the Office of Land Use and Climate Innovation to map eligible urban infill sites by July 1, 2027, after local review and public comment.
  • Infill guidelines and records. Required updates to the § 21094.5 infill guidelines every two years from January 1, 2027 (§ 21094.5.5) and, except for distribution center and oil and gas projects, excluded staff notes and most internal emails from the record of proceedings (§ 21167.6).
  • Homelessness funding. Established round 7 of the Homeless Housing, Assistance, and Prevention program (Health & Saf. Code § 50245), conditioned on future legislation and progress on round 6.

Article 3 (commencing with Section 50245) is added to Chapter 6.5 of Part 1 of Division 31 of the Health and Safety Code, to read:

SEC. 2

The Legislature finds and declares both of the following:

(a) The California Environmental Quality Act (CEQA; Division 13 (commencing with Section 21000) of the Public Resources Code) provides communities across California with important safeguards against projects like fossil fuel plants and warehouses that have caused real environmental harm to residents of the state. Too often it has resulted in delays to essential projects that are key to solving the state’s housing crisis and to strategic development that is necessary to maintain California’s position as the fourth largest economy in the world.

(b) Over the last several years, the Legislature has enacted numerous provisions that streamline CEQA, including, but not limited to, reforms to administrative records, court timelines, and the level of environmental review of projects in the areas of water, transportation, clean energy, and housing.

(c) CEQA should not be used primarily for economic interests, to stifle competition, to gain competitive advantage, or to delay a project for reasons unrelated to environmental protection.
