Gov. Code § 65863

Gov. Code § 65863

No net loss of residential capacityTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 2. Adoption of Regulations

Key provisions · Claude summary, not statute text

The “no net loss” law requires each jurisdiction to keep enough housing element sites throughout the planning period to accommodate its remaining RHNA, and restricts density reductions or lower-unit approvals on inventory sites unless findings are made or replacement sites are identified.

  • Adequate sites at all times. The housing element inventory or rezoning program, including sites rezoned under § 65584.09, must accommodate the remaining unmet RHNA share and any unaccommodated prior-period need at all times, and no action may make the inventory insufficient for the remaining lower and moderate-income need, except as provided in (c)(2). (a)
  • Density reduction findings. A jurisdiction may not reduce, or allow development at, a “lower residential density” on an inventory parcel unless it makes written findings, supported by substantial evidence, that the reduction is consistent with the general plan and housing element and that remaining sites are adequate, quantifying remaining unmet need and site capacity by income level. (b)(1)
  • Fewer units approved. If a parcel is approved with fewer units by income category than the housing element identified, the jurisdiction must make a written finding, with quantification by income level, on whether remaining sites are adequate. (b)(2)
  • Replacement sites. A density reduction that leaves inadequate sites is allowed only if sufficient additional adequate and available sites of equal or greater density are identified so there is no net loss of capacity. If a project approval leaves inadequate sites, the jurisdiction must identify and make available additional sites within 180 days, but may not disapprove a housing project on that basis. (c)
  • Responsibility. The jurisdiction is solely responsible for compliance unless the applicant’s initial application requests a density that would leave remaining sites inadequate, in which case the applicant may be required to comply; submission does not depend on the application being deemed complete. (e)
  • Other laws and exemptions. The requirements are in addition to other density reduction limits, and do not apply to parcels that before January 1, 2003, were subject to a development agreement or had a subdivision map application submitted. (d), (f)
  • Lower residential density. With a compliant housing element, “lower residential density” means fewer units than projected for an inventory site under § 65583.2(c) or for a rezone program site. Without a timely adopted or compliant element (90 or 180 days after the § 65588 deadline, extended for COG allocation delays), it means below 80 percent of the maximum allowable density or the § 65583.2(c)(3) density, whichever is greater. (g)
  • CEQA. An action obligating a jurisdiction to identify additional sites creates no CEQA obligation to analyze that later site action as a reasonably foreseeable consequence, without deciding whether that action is a CEQA “project.” (h)
  • Definitions and charter cities. “Unaccommodated portion of the regional housing need” means prior-period need required to be accommodated on sites zoned or rezoned under § 65584.09. Applies to charter cities notwithstanding § 65803. (i), (j)
