Transfers of allocation between jurisdictionsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Allows the County of Napa and the City of Napa, by agreement, to let one jurisdiction report on its annual housing production report entitlements, permits, and certificates of occupancy issued by the other, subject to compliance, hearing, and findings requirements.

  • Legislative findings. The Legislature finds a statewide housing crisis, describes Napa County’s agricultural and open-space restrictions and the Napa Pipe project (at least 700 units, up to 945 with a density bonus) partly annexed by the City of Napa, and declares this a unique circumstance not intended as precedent. (a)(1)–(8)
  • Reporting agreement. The County and City of Napa may agree to let one report, under § 65400(a)(2)(H), completed entitlements, building permits, and certificates of occupancy issued by the other, if all conditions are met. (b)
  • Eligibility conditions. Both must have HCD-compliant housing elements, have submitted annual reports within the prior 12 months, and the same items may not be reported by both jurisdictions. (b)(1)–(3)
  • Qualifying developments. The development must be on county housing element land later annexed by the City of Napa after the final allocation (with written confirmation the methodology did not account for the annexation and no § 65584.07(d) transfer), on land owned by one jurisdiction inside the other’s boundaries, or within one jurisdiction and funded by the other. (b)(4)
  • Public hearings. Before approval, the Board of Supervisors and City Council each hold a public hearing and make the proposed agreement available showing compliance, each development site, units by income category, and units shown on each jurisdiction’s report. (b)(5)
  • Required findings. Each body must approve the agreement with written findings on substantial evidence that it complies with this section, will not cause or exacerbate racial, ethnic, or economic segregation, excludes developments in census tracts over 50 percent very low income households unless within one-half mile of a major transit stop or high-quality transit corridor, and excludes developments that reduce the number or affordability of units on site. (b)(6)
  • No net loss duty. The section does not reduce § 65863 obligations; if a site under an agreement is no longer adequate, the jurisdiction must comply with § 65863(c), and failure is a violation under § 65585(j) that HCD must report to the Attorney General under § 65585.3. (c)
