Key provisions · Claude summary, not statute text

Requires ministerial approval, without discretionary review or a hearing, of housing developments of up to two units in single-family zones (SB 9 duplexes) on eligible parcels, subject to limited objective standards.

  • Eligible locations. The parcel must be in a city that includes part of a Census Bureau urbanized area or urban cluster, or, in unincorporated areas, wholly within one, and must satisfy § 65913.4(a)(6)(B)–(K) as it read on September 16, 2021. (a)(1)–(2)
  • Protected housing. The project may not require demolition or alteration of housing with recorded affordability restrictions for moderate, low, or very low income households, housing under rent or price control, or housing occupied by a tenant in the last three years. (a)(3)
  • Ellis Act and historic exclusions. Ineligible if the owner withdrew units from rent under the Ellis Act (§ 7060 et seq.) within 15 years before application, or if the site is a contributing structure in a historic district, an individually listed historical resource on the State Historic Resources Inventory, or a local landmark. (a)(4)–(5)
  • Objective standards. Local agencies may impose objective zoning, subdivision, and design review standards that do not conflict with the section, but not ones that physically preclude up to two units or either unit being at least 800 square feet, or that do not apply uniformly in the underlying zone; more permissive standards are allowed, as are objective standards to maintain a California Register historic district. (b)(1)–(4)
  • Setbacks. No setback may be required for an existing structure or one rebuilt in the same location and dimensions; otherwise side and rear setbacks may be up to four feet. Adjacent or connected structures may not be rejected solely for that reason if they meet building code safety standards and allow separate conveyance. (b)(2)(B), (g)
  • Parking and septic. Agencies may require up to one offstreet parking space per unit, but none within one-half mile walking distance of a high-quality transit corridor or major transit stop, or within one block of a car share vehicle. For onsite wastewater systems, a percolation test within the last 5 years (or 10 years if recertified) may be required. (c)
  • Denial. A project may be denied only if the building official makes a written finding, based on a preponderance of the evidence, of a “specific, adverse impact” under § 65589.5(d)(2) on public health and safety that cannot feasibly be mitigated or avoided. (d)
  • Rentals and ADUs. Rentals of units created under the section must be for terms longer than 30 days. Agencies need not permit an ADU or JADU on parcels that use both this section and § 66411.7. (e), (f)
  • 60-day deadline. A completed application must be approved or denied within 60 days or it is deemed approved. A denial must include, within that period, written comments listing defective or deficient items and how to remedy them. (h)
  • Definitions. A development contains two units if it proposes no more than two new units or adds one unit to one existing unit. Defines “objective zoning standards,” “objective subdivision standards,” and “objective design review standards,” and “local agency” (general law or charter). (i)
  • Implementing ordinance. Local agencies may adopt an implementing ordinance, which is not a “project” under CEQA. (j)
  • Coastal Act. The Coastal Act still applies, except no public hearings are required for coastal development permit applications for projects under this section. (k)
