Gov. Code § 65860

Consistency with the general planTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 2. Adoption of Regulations

Key provisions · Claude summary, not statute text

Requires city and county zoning ordinances, including charter cities’, to be consistent with the general plan, provides an enforcement action, and governs development applications when zoning becomes inconsistent after a general plan amendment.

  • Consistency. Zoning had to be consistent with the general plan by January 1, 1974. Zoning is consistent only if a plan has been officially adopted and the uses authorized are compatible with the plan’s objectives, policies, general land uses, and programs. (a)
  • Enforcement action. A resident or property owner may sue in superior court under Code of Civil Procedure § 1084 et seq., but must file and serve the legislative body within 90 days of enactment or amendment of a zoning ordinance or the agency’s failure to comply. (b)
  • Reasonable time to amend. When a general plan amendment makes zoning inconsistent, zoning must be amended within a reasonable time. (c)(1)
  • Inconsistent zoning applications. For a project not subject to § 65589.5 that is consistent with the general plan but not zoning, the agency must either amend inconsistent zoning within 180 days of the application or process it applying objective general plan standards, not inconsistent zoning, to accommodate the general plan density; such a project is not deemed inconsistent with zoning or required to be rezoned. If zoning is not amended in 180 days, the second option applies. (c)(2)–(3)
  • Charter cities. Applies to charter cities notwithstanding § 65803. (d)
