Key provisions · Claude summary, not statute text

Sets deadlines after which an application for an electric vehicle charging station is deemed complete and then deemed approved, and requires parking reductions to accommodate stations.

  • Legislative findings. EV charging stations are a matter of statewide concern, so the section applies to charter cities; GO-Biz’s July 2019 guidebook recommends practices supporting a 15-day permitting timeline consistent with AB 1236. (a)
  • Deemed complete. An application is deemed complete if, after 5 business days (1–25 stations at a single site) or 10 business days (more than 25 stations), the building official has neither deemed it complete under the § 65850.7(g) checklist nor issued a written correction notice detailing all deficiencies. (b)
  • Deemed approved. An application is deemed approved if 20 business days (1–25 stations) or 40 business days (more than 25 stations) pass after it was deemed complete and the official has not approved it, made a specific adverse impact finding or required a use permit, or denied it, and no appeal has been made to the planning commission. (c)
  • Parking reduction. If a station and its equipment affect required parking for existing uses, the jurisdiction must reduce required parking by the amount needed to accommodate them. (d)
  • Publicly owned utilities. The section does not expand or restrict a local publicly owned electric utility’s role in providing new electric service to a station consistent with safety, reliability, and engineering requirements. (e)
  • Operative date. Operative January 1, 2022, but applies beginning January 1, 2023, for jurisdictions under 200,000 residents. (f)
