Solar energy systemsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 2. Adoption of Regulations

Key provisions · Claude summary, not statute text

Requires administrative, nondiscretionary approval of solar energy systems, limits denials to specific health and safety impacts, and mandates an expedited permitting process for small residential rooftop systems.

  • Statewide policy. Solar installation standards are a statewide concern; local agencies should not create unreasonable barriers, including aesthetic design review. (a)
  • Administrative approval. Applications must be approved through a building permit or similar nondiscretionary permit, with review limited to health and safety requirements; a use permit may be required only if the building official finds, based on substantial evidence, a possible specific, adverse impact on public health and safety. (b)
  • Denial and conditions. A use permit may be denied only on written findings of a specific, adverse impact with no feasible mitigation, including reasons for rejecting alternatives; decisions are appealable to the planning commission, and conditions must mitigate the impact at the lowest cost possible. (c)–(e)
  • Technical standards. Systems must meet health and safety standards, water heating systems must be certified by an accredited listing agency, and electric systems must meet Electrical Code, IEEE, testing laboratory, and PUC standards. (f)(1)–(3)
  • Excavation notice. By January 1, 2021, applications and the California Solar Permitting Guidebook must reference the duty to notify the regional notification center before excavating; local agencies are not liable for a permittee’s failure to notify. (f)(4)–(6)
  • Expedited permitting. By September 30, 2015, every jurisdiction must adopt an ordinance creating an expedited, streamlined process for small residential rooftop systems with a checklist; complete applications must be approved, incomplete ones receive a written correction notice. The checklist must be published online, electronic submittal and signatures allowed (or reasons stated), and the process must substantially conform to the Guidebook, with modifications allowed for unique local conditions. (g)
  • Inspection and HOAs. Expedited systems require only one timely inspection (a separate fire inspection is allowed in some cases), and permit approval may not be conditioned on homeowners association approval. (h), (i)
  • Definitions. Defines “a feasible method to satisfactorily mitigate or avoid the specific, adverse impact,” “electronic submittal,” “small residential rooftop solar energy system” (no larger than 10 kW AC or 30 kW thermal, code-compliant, on a single-family or duplex dwelling, within height limits), “solar energy system,” and “specific, adverse impact.” (j)
