Floating home marina conversionsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 2. Adoption of Regulations

Key provisions · Claude summary, not statute text

Requires a report on the impact on displaced residents before a floating home marina is converted, closed, or ceases operation, and allows the legislative body to require mitigation.

  • Impact report. Before conversion (other than under the Subdivision Map Act), closure, or cessation of use of a floating home marina, the proponent must file a report on the impact on displaced residents, addressing replacement housing in floating home marinas and relocation costs. (a)
  • Resident copies. A copy must go to a resident of each floating home at least 15 days before any hearing, or, for closure or cessation, at the same time as notice under Civil Code § 800.71(f). (b), (c)
  • Hearing. For closure or cessation, the filer or any resident may request and has a right to a hearing before the legislative body on the report’s sufficiency. (d)
  • Mitigation. The legislative body or advisory agency must review the report before any change of use and may require mitigation of impacts on residents’ ability to find housing, not exceeding the reasonable costs of relocation. (e)
  • Exceptions. The section does not apply when closure results from an order for relief in bankruptcy; it applies where closure results from a governmental decision not to renew a permit or variance or other zoning action, but government agencies need not mitigate. (f), (i)
  • Fees. The legislative body may set reasonable fees, paid by the proponent, to cover its implementation costs. (g)
  • Applicability. Applies to charter cities, to floating home marinas as defined in Civil Code § 800.4, and to nonprofit-managed marinas or harbors governed by berthholder majority vote with berths for fewer than 25 floating homes. (h), (j)
