Key provisions · Claude summary, not statute text

Requires an impact report with a replacement and relocation plan before a mobilehome park is converted, closed, or ceases use, and authorizes local mitigation conditions.

  • Impact report. Before conversion (other than under the Subdivision Map Act), closure, or cessation of use, the person or entity proposing the change must file an impact report with a replacement and relocation plan that adequately mitigates residents’ ability to find adequate housing in a mobilehome park. (a)(1)(A)
  • Disaster closures. For disaster-related changes, the report must include an HCD technical service inspection report, and park management is the party proposing the change. The in-place value payment does not apply to disaster-related changes. (a)(1)(B), (a)(2)(D), (k)
  • In-place market value. If a displaced resident cannot obtain adequate housing in another park, the proponent must pay the in-place market value of the mobilehome, determined by a state-certified appraiser assuming continuation of the park, with the appraisal paid for by the proponent and included in the report. (a)(2)(A)–(C)
  • Resident notice and hearing. A copy of the report must go to a resident of each mobilehome at least 60 days before any hearing, or with the Civil Code § 798.56(g)(2) notice if filed before closure; the filer or a resident may request a hearing on the report’s sufficiency before the legislative body. (b)–(d)
  • Findings and mitigation. Before approving a change of use, the legislative body or advisory agency must review the report and find whether the closure and conversion will result in or materially contribute to a shortage of low- and moderate-income housing, and may require mitigation of impacts on displaced residents. (e)
  • Bankruptcy and fees. The section does not apply to closures resulting from an order for relief in bankruptcy. Reasonable fees under § 66016 may be charged to the proponent to cover costs of this section and § 65863.8. (f), (g)
  • Government-caused closures. Applies when closure results from nonrenewal of a conditional use permit or variance or other zoning action or inaction (the local agency is then the proponent), or from an enforcement agency suspending the permit to operate (the park owner is then the proponent). (i), (j)
  • Charter cities and minimum standard. Applies to charter cities and sets a minimum standard; local agencies may enact more stringent measures. (h), (l)
