Carryover of unaccommodated needTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Requires a city or county that failed to provide adequate sites for its regional housing need in the prior planning period to rezone for that unaccommodated need within the first year of the new planning period.

  • Carryover rezoning. For housing elements due on or after January 1, 2006, a jurisdiction that failed to identify or make available adequate sites in the prior period must, within the first year of the new period, zone or rezone adequate sites for the unaccommodated portion of the prior allocation. (a)
  • Additional obligation. This rezoning is in addition to any zoning or rezoning needed for the new period’s regional housing need. (b)
  • Existing duties preserved. The section does not diminish the duty to accommodate the share for each income level, including implementing § 65583 programs (including rezoning) and timely adopting an element with a sites inventory and a program to make sites available. (c)
