Gov. Code § 65584

Regional housing need: determination and allocationTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 3. Local Planning › ARTICLE 10.6. Housing Elements

Key provisions · Claude summary, not statute text

Establishes the regional housing needs process: HCD determines each region’s housing need and the council of governments (or HCD) adopts a plan allocating shares to each jurisdiction, guided by statutory objectives.

  • Regional need. For the fourth and later revisions, HCD determines each region’s existing and projected need, and a jurisdiction’s share includes need for all income levels in the area affected by its general plan. (a)(1)
  • Legislative intent. Jurisdictions should take all necessary actions to facilitate housing for the entire regional need, including § 65582.1 reforms; the Legislature finds insufficient housing in job centers undermines climate and clean air goals. (a)(2)–(3)
  • Determination deadlines. HCD determines regional need at least three years before the revision (two years for 2027 due dates; 32 months for 2028 or early 2029 due dates; 24 months for areas without a council of governments). (b)(1)
  • Allocation plan. The council of governments, or HCD where there is none, adopts the final allocation plan at least one year before the revision, under §§ 65584.04 and 65584.05. (b)(2)
  • Census extension. HCD may extend due dates by up to 60 days to use more recent Census Bureau or Department of Finance data, extending the housing element deadline correspondingly. (c)
  • Allocation objectives. The plan must increase supply and mix of housing equitably (each jurisdiction receives low- and very low income units; extremely and acutely low income units within 3% of very low income need); promote infill, equity, resource protection, efficient development, and GHG targets; improve jobs-housing fit; avoid overconcentrating income categories; and affirmatively further fair housing. (d)
  • Definitions. Defines “affirmatively furthering fair housing” and “household income levels” (very low, lower, moderate, above moderate through the sixth revision; acutely low through above moderate per § 65582 for the seventh and later). (e)–(f)
  • CEQA exemption. Determinations under this section and §§ 65584.01–65584.08 are exempt from CEQA. (g)
