Interim urgency ordinancesTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 2. Adoption of Regulations

Key provisions · Claude summary, not statute text

Authorizes counties and cities, including charter cities, to adopt interim urgency zoning ordinances (moratoria) prohibiting uses that may conflict with plans or zoning under study, with time limits, required findings, and extra limits on multifamily housing moratoria.

  • Urgency adoption. To protect public safety, health, and welfare, the legislative body may adopt, by four-fifths vote and without normal zoning procedures, an interim ordinance prohibiting uses that may conflict with a contemplated general plan, specific plan, or zoning proposal under study or to be studied within a reasonable time. (a)
  • Duration and extensions. The ordinance lasts 45 days. After § 65090 notice and hearing it may be extended for 10 months and 15 days and then one year, by four-fifths vote, with no more than two extensions. Alternatively, it may be adopted after notice and hearing for 45 days and extended once for 22 months and 15 days. (a), (b)
  • Required findings. No interim ordinance may be adopted or extended without findings of a current and immediate threat to public health, safety, or welfare, and that approving additional entitlements would result in that threat. (c)
  • Multifamily housing. An ordinance denying approvals for projects with a significant multifamily component may be extended only on written findings, supported by substantial evidence, of a “specific, adverse impact” on public health or safety, that the ordinance is necessary to mitigate it, and that no less burdensome feasible alternative exists. (c)(1)–(3)
  • Report. Ten days before the ordinance or any extension expires, the legislative body must issue a written report describing measures taken to alleviate the condition. (d)
  • Successive ordinances. Later interim ordinances covering the same property terminate with the first ordinance, but a new one may be adopted after termination for a different event, occurrence, or set of circumstances. (e), (f)
  • Definitions. “Development of multifamily housing projects” excludes demolition, conversion, redevelopment, or rehabilitation of lower income affordable multifamily housing or that raises prices or reduces affordable units. “Projects with a significant component of multifamily housing” means at least one-third of total square footage is multifamily. (g), (h)
