No minimum parking near public transitTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 2. Adoption of Regulations

Key provisions · Claude summary, not statute text

Prohibits public agencies from imposing minimum automobile parking requirements on development projects within one-half mile of public transit (a major transit stop), with limited exceptions.

  • Parking minimums barred. A public agency may not impose or enforce any minimum automobile parking requirement on a residential, commercial, or other development project within one-half mile of public transit. (a)
  • Local findings exception. A city or county may impose minimums if, within 30 days of a completed application, it makes written findings, supported by a preponderance of the evidence, that not doing so would substantially and negatively affect its ability to meet low and very low income RHNA, special housing needs of the elderly or persons with disabilities under § 65583(a)(7), or existing residential or commercial parking within one-half mile. (b)
  • Housing projects shielded. The findings exception does not apply to housing projects that dedicate at least 20 percent of units to very low, low, or moderate income households, students, the elderly, or persons with disabilities; have fewer than 20 units; or are subject to parking reductions under other law. (c)
  • Event centers. Event centers must still provide parking required by local ordinance for employees and other workers. (d)
  • Definitions. Defines “housing development project” (§ 65589.5(h)(2)), “low- and very low income households,” “moderate-income households,” “public agency” (including the state and charter cities), “public transit” (a major transit stop under Pub. Resources Code § 21155), and “project” (excluding any transient lodging portion other than a residential hotel). (e)
  • EV and accessible parking. Requirements for EV supply equipment spaces or accessible spaces that would otherwise apply to new multifamily or nonresidential development are not reduced. (f)
  • Voluntary parking. For voluntarily provided parking, agencies may require car share spaces, public sharing, or charging for parking, but may not require that it be free to residents. (g)
  • Existing contracts. Subdivision (a) does not apply to commercial parking requirements in conflict with an agency contract executed before January 1, 2023 (or later amended without increasing commercial parking), if all required commercial parking is shared with the public; projects may voluntarily build additional unshared parking. (h)
  • Interpretation. Parking minimums can increase housing costs, limit units, oversupply parking, and increase greenhouse gas emissions, so the section is interpreted in favor of the prohibition. (i)
