Emergency standby generatorsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 2. Adoption of Regulations

Key provisions · Claude summary, not statute text

Made qualifying emergency standby generators at existing macro cell tower sites a permitted use subject to administrative, nondiscretionary review with a 60-day decision deadline; repealed as of January 1, 2024.

  • Definitions. Defines “emergency standby generator,” “local agency,” and “macro cell tower site” (excluding rooftop, small cell, and distributed antenna system sites). (a)
  • Permitted use. A generator serving a macro cell tower site is a permitted use reviewed administratively if it is rated below 50 horsepower, meets air quality rules, has a double-wall tank of no more than 300 gallons on a concrete pad, totals no more than 250 cubic feet with its tank, is within 100 feet of the tower or base station, complies with building and fire codes, and the site was previously permitted. (b)(1)–(5)
  • 60-day decision. The agency must approve or deny within 60 days of submittal. A written incompleteness notice within 10 days suspends the clock and must list all missing information; later reviews may not request new items, and a resubmittal starts a new 60-day period. No new or different information may be required than for other emergency standby generators. (c)
  • Deemed approved. A completed application not acted on within 60 days, or after any tolling period, is deemed approved; the agency may still revoke approvals or enforce law for violations. (d)
  • Multiple permits. Where more than one permit is required, all concurrently submitted applications must be issued within the same 60-day period. (e)
  • Owner consent. Proof of property owner consent may not be required in the initial application, but the generator may not be installed until any required documentation is provided. (f)
  • Fees. A permit fee may cover administration costs but may not exceed reasonable costs or be levied for general revenue. (g)
  • Sunset. The section remained in effect until January 1, 2024, and as of that date is repealed. (h)
