Accessory dwelling unit preapproval programTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 2. Adoption of Regulations

Key provisions · Claude summary, not statute text

Requires local agencies to create an accessory dwelling unit plan preapproval program by January 1, 2025, and to act within 30 days on detached ADU applications using preapproved or previously approved plans.

  • Preapproval program. By January 1, 2025, each local agency must accept ADU plan submissions for preapproval from anyone, approve or deny them under Article 2 (commencing with § 66314) of Chapter 13, and may charge the same permit fees as for a same-sized ADU. (a)(1)–(3)
  • Website posting. Preapproved plans and applicant contact information must be posted on the agency’s website, without constituting an endorsement or approval of any detached ADU application; the agency is not responsible for contact accuracy and must remove a plan within 30 days of the applicant’s request. (a)(4)
  • Other plans. Agencies may also admit plans they developed and preapproved, or plans preapproved by other agencies in the state. (a)(5)
  • 30-day approval. A detached ADU application must be approved or denied ministerially under §§ 66317 and 66320 within 30 days of a completed application if it uses a plan preapproved by the agency, or identical to a plan approved for a detached ADU, within the current triennial Building Standards Code cycle. (b)
  • Definitions and charter cities. “Accessory dwelling unit” and “local agency” have the meanings in § 66313. The lack of housing is a matter of statewide concern, so the section applies to charter cities. (c), (d)
