Additions to existing mobilehome parksTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 2. Adoption of Regulations

Key provisions · Claude summary, not statute text

Lets owners of existing mobilehome parks add lots, up to 10 percent of approved lots, through enforcement agency permits without local zoning approvals, with rent control and amenity protections.

  • Eligible owners. Applies to owners of existing parks subject to, or intending to qualify for, a valid permit to operate under Health and Safety Code § 18505 that is not suspended under § 18510. (a)
  • Lots allowed. Owners may add lots for single-family manufactured homes, multifamily manufactured homes on lots previously occupied by a single-family mobilehome or manufactured home, or a combination, up to 10 percent of the previously approved number of lots. (a)(1)–(3)
  • Multifamily lot protections. A multifamily manufactured home lot is not “new construction” under Civil Code § 798.7 for § 798.45 purposes, and converting lots may not be a basis for park closure or conversion under §§ 65863.7 or 66427.4 or for terminating tenancies under Civil Code § 798.56(g). (a)(2)(A)–(B)
  • Enforcement agency permits. The owner must first obtain all permits needed to increase occupancy. The enforcement agency must require reasonable information showing services such as water, sewage, electrical, and gas are not substantially impacted, may require evidence of local health, utility, and fire compliance, and the owner must then update the permit to operate. (b)
  • Fees and taxes. Added lots are not subject to any business tax, registration fee, use permit fee, or other fee except those applicable to existing lots, such as property taxes, water, sewer, and garbage fees, normal inspection fees, and bond assessments. (c)
  • No zoning approvals. Added lots are deemed to comply with the park’s existing zoning and land use approvals, are not a different use under local ordinances, and may not be required to obtain a conditional use permit, variance, or other zoning approval. (d)–(f)
  • Amenities protected. Owners may not reduce or interfere with in-use amenities (such as pools, clubhouses, playgrounds, laundry, RV storage, community spaces) or occupied spaces without first complying with Health and Safety Code § 18610.5. (g)
  • Rent control. An added lot is “new construction” under Civil Code § 798.7, with rent control exemption determined by § 798.45, but it may not change the number or percentage of exempt lots or make existing lots exempt. (h), (i)
  • Coastal exclusion. Does not apply to parks in coastal zone areas subject to Public Resources Code § 30603(a)(1) or (2). (j)
  • Charter cities. Streamlining new lots in existing parks is a matter of statewide concern, so the section applies to all cities, including charter cities. (k)
