Key provisions · Claude summary, not statute text

Requires owners of “assisted housing developments” to give advance notice to tenants and public entities before a subsidy contract terminates, rental restrictions expire, or a federally backed mortgage is prepaid, and sets the content, timing, and service of those notices.

  • Definitions. Defines “affected public entities,” “affected tenant,” “assisted housing development” (a multifamily rental development of five or more units receiving assistance under listed federal, state, tax-credit, bond, CDBG, HOME, HCD, CalHFA, and local rent/income-restricted programs, but not tenant-based Housing Choice Vouchers or local rent control), “city,” “expiration of rental restrictions,” “low or moderate income,” “owner,” “prepayment,” and “termination.” (a)(1)–(9)
  • Joint owners. Where the development is subject to a leasehold, the landowner and the leasehold owner are jointly responsible for compliance. (a)(7)
  • 12-month notice. At least 12 months before termination, expiration of rental restrictions, or prepayment, the owner must notify each affected tenant household and the affected public entities, stating the intended action, the anticipated date and program, whether rents might rise in the following 12 months, that affordability restrictions would be removed, whether the owner can or expects to stay in the program, whether other assistance will be provided, that a six-month notice will follow, and that the notice of opportunity to purchase under § 65863.11 has been sent and posted. (b)(1)(A)–(I)
  • Federal notice. A federally required termination or prepayment notice given at least 12 months ahead to the same recipients and compliant with federal law satisfies subdivision (b), but not § 65863.11. (b)(2)
  • Six-month notice. At least six months before the change, the owner must again notify tenants and affected public entities, giving the anticipated date and program, current and anticipated rent for the following 12 months, that copies go to the city/county, housing authority, and HCD, the possibility of remaining in the program, the owner’s intent to participate in replacement subsidies, that all enhanced Section 8 vouchers will be accepted, and contacts for the public entities and a legal services organization. (c)(1)–(2)
  • Notice to public entities. The six-month notice to public entities must also give unit, tenant, bedroom, assistance, age, and income data, the owner’s plans, timetables, required approvals, reasons, and contacts with other agencies, plus any federally required notice, based on reasonably available records. (c)(3)
  • Significant changes. Owners must give additional notice of any “significant changes” to the six-month notice, such as changes to the date or anticipated new rent, within seven business days. (d)
  • Prospective tenants; posting. Copies of notices must be given to prospective tenants at their eligibility interview, and owners three years from a scheduled expiration or termination (where restrictions expire after January 1, 2021) must post notice in an accessible location until it occurs and provide it to affected public entities. (e)
  • Records; liability. Owners need not obtain or update information beyond existing tenant and project records and are not liable for inaccuracies in those records or for providing the information. (f)
  • Service. Notice to tenants must be by first-class mail postage prepaid; notice to public entities and HCD may be by first-class mail or electronically to an entity that provided an email address. (g)
  • Savings; prior compliance. The section does not enlarge or diminish other authority, and an owner that accepted a bona fide offer from a qualified entity before January 1, 2001, and complied with prior law is deemed in compliance. (h), (i)
  • Enforcement. Aggrieved affected tenants, public entities, tenant organizations, or tenant associations may obtain injunctive relief, including reimposition of prior restrictions and restitution of rent increases, and a prevailing plaintiff may be awarded attorney’s fees and costs. (j)
  • HCD forms. The Director of HCD must approve forms, and owners must use the approved forms to comply with subdivisions (b), (c), and (e). (k)
