Key provisions · Claude summary, not statute text

Exempts an owner from the notice and purchase-opportunity requirements of §§ 65863.10 and 65863.11 when a recorded regulatory agreement contains specified tenant and affordability protections.

  • Exemption conditions. No notice is required if a regulatory agreement recorded at close of escrow contains all listed conditions and the owner complies during escrow. (a)
  • Tenant protections. No low-income tenant residing within 12 months of expiration may be permanently involuntarily displaced absent a lease breach; tenancies may not be terminated at lease end without a breach or due to planned renovation. (a)(1), (a)(4)
  • Section 8. The owner must accept and use all project-based Section 8 renewals if available at a fiscally viable level, and accept all enhanced Section 8 vouchers and other Section 8 vouchers for future vacancies. (a)(2)–(3)
  • Tenant selection. The owner may consider the amount of income in selecting applicants if other factors bearing on ability to pay rent are adequately considered. (a)(5)
  • Affordability levels. A new recorded agreement must restrict previously restricted units to an equal or greater level of affordability; formerly project-based units that become unassisted are capped at 30 percent of 60 percent of AMI, and other unassisted units at the greater of 30 percent of 50 percent of AMI or Section 241(f) regulated rents, with the owner applying for any available rental assistance. (a)(6)–(8)
  • Over-income households. Households over the income limit pay no more than 30 percent of adjusted income, with increases capped at 10 percent annually. (a)(9)
  • Definitions. Defines “regulatory agreement” as an agreement with a governmental agency obligating the owner and successors to maintain affordability for the greater of the existing assistance term or 30 years. (b)
  • Effect on § 65863.11. Section 65863.11 does not apply to a development whose owner is exempt under this section. (c)
