Rebuilding damaged multifamily dwellingsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4. Zoning Regulations › ARTICLE 2. Adoption of Regulations

Key provisions · Claude summary, not statute text

Bars local agencies, including charter cities, from prohibiting the rebuilding of multifamily dwellings involuntarily damaged or destroyed by fire, other catastrophe, or the public enemy, except in limited circumstances.

  • Right to rebuild. No local ordinance, regulation, or resolution may prohibit reconstruction, restoration, or rebuilding of a “multifamily dwelling” involuntarily damaged or destroyed by fire, other catastrophic event, or the public enemy. (a)
  • Exceptions. Rebuilding may be prohibited if the agency determines it would be detrimental or injurious to neighborhood health, safety, welfare, or property; that the nonconforming use should be moved to a zone where it is permitted or no such zone exists; or if the building is in an industrial zone. (b), (f)
  • Size and use. The dwelling may be rebuilt up to its predamaged size and number of units, and any nonconforming use may resume. (c)
  • Applicable standards. Rebuilding must conform to the California Building Standards Code and authorized more restrictive local building standards in effect at the time, the State Historical Building Code for qualified historical buildings, and local zoning and architectural standards so long as predamage size and unit count are maintained. (d)(1)–(5)
  • Permit deadline. A building permit must be obtained within two years after the date of damage or destruction. (d)(6)
  • More permissive rules. Local agencies may grant greater or more permissive rebuilding rights. (e)
  • Charter cities and definitions. Applies to charter cities notwithstanding § 65803. A “multifamily dwelling” is any structure for human habitation divided into two or more independent living quarters. (g), (h)
