Provides for ministerial approval of housing development projects on lots subdivided under § 66499.41, limiting the objective standards local agencies may impose and setting a 60-day decision deadline.

  • Eligible projects. A development proponent may apply for a housing development project on a lot subdivided under § 66499.41 that meets this section’s requirements. (a)
  • Objective standards. Local agencies may impose objective zoning, subdivision, or design standards related to the development or parcel design or improvement that do not conflict with this section or § 66499.41. (b)(1)
  • Density and height. Standards may not physically preclude development at the § 65583.2(c)(3)(B) density, though higher densities may be allowed; for lots meeting § 66499.41(a)(2)(A)(ii), a height limit no lower than existing zoning may be imposed. (b)(2)(A)
  • Prohibited standards. Agencies may not impose requirements based on approval under this section, setbacks between units beyond the Building Code, enclosed or covered parking, side and rear setbacks inconsistent with § 65852.21(b)(2)(B), or parking inconsistent with § 65852.21(c)(1). (b)(2)(B)–(F)
  • Floor area ratio. Agencies may not impose a floor area ratio below 1.0 for projects of three to seven units, or below 1.25 for projects of 8 to 10 units. (b)(2)(G)
  • Ministerial review. Applications must be considered ministerially without discretionary review or a hearing, and approved or denied within 60 days of a completed application or deemed approved; a denial must include written comments listing deficiencies and how to remedy them. (c)
  • Disapproval. A project may be disapproved only on a written finding, based on a preponderance of the evidence, of a “specific, adverse impact” under § 65589.5(d)(2) on public health and safety that cannot feasibly be mitigated or avoided. (d)
  • Ordinance and operative dates. Implementing ordinances are not a CEQA project. The section is operative July 1, 2024, and its later amendments are operative July 1, 2025. (e)–(g)
